The following summarises the terms and conditions applying to the sale of online and/or print publications by Michael Rubenstein Publishing Limited.

Michael Rubenstein Publishing – Terms & Conditions of Sale (General)
1. General
1.1 These terms and conditions are incorporated into all orders for publications (“the Goods“) supplied by Michael Rubenstein Publishing Limited (“the Supplier“) except for software supplied under the terms of a software licence or where there is a prior written agreement between the Customer and the Supplier.
1.2 No variation to these terms and conditions shall be binding unless agreed in writing between the Supplier and the customer.
1.3 Goods delivered may differ in non-material respects from those advertised in the Supplier’s catalogue or other promotional material.
2. Price
2.1 Subject to paragraph 2.2 below the price payable for Goods shall be the total price plus, if applicable, any cost of packaging, postage and delivery as specified in the Supplier’s current price list or catalogue, less any discount agreed in advance in writing by the Supplier.
2.2 The price is exclusive of Value Added Tax which the customer shall be additionally liable to pay to the Supplier.
2.3 Prices and delivery charges are subject to change without notice.
3. Payment Terms
3.1 Unless otherwise agreed in writing by the Supplier all invoices are payable by the date for payment stated on the invoice in pounds sterling drawn on a bank based in the UK or by such other method as is agreed in advance by the Supplier.
3.2 Failure to pay all amounts due by the due date may result in: (a) withholding of further supplies including subscription supplies in respect of which the customer has made payment in full; and/or (b) charging of interest on amounts outstanding at the rate of 4% above the Bank of England base rate from time to time.
4. Credit Terms
The Supplier may set and vary credit limits from time to time and withhold all further supplies if the customer exceeds such credit limit.
5. Terms of Supply
Subscriptions run for a full year and no credit will be given for cancellations during the year.
6. Delivery
6.1 Orders are accepted by the Supplier subject to availability of stock and may be delivered in two or more instalments. Time of delivery is not of the essence. The Supplier has no liability for any loss of trade or profit occurring to the customer as a result of delay in delivery or delivery of incorrect or faulty goods.
6.2 Delivery will be made to the business address of the customer or its agent or to a carrier designated by the customer. Delivery to an address in the UK or Eire is subject to such delivery charges, if applicable, as appear in the Supplier’s price list or catalogue. Delivery outside the UK and Eire is at the cost and risk of the customer.
6.3 Risk in the Goods passes to the customer on delivery under paragraph 6.2 above. Title to Goods other than subscription products will pass to the customer on payment in full. Title in subscription items will pass on delivery.
7. Online products
Delivery of online products is made using the World Wide Web. All warranties, express or implied, regarding the availability of any online product at any particular time or times are excluded.
8. Loss or damage in transit and claims for missing issues
8.1 Claims for damage or partial delivery must be notified within 30 (thirty) days of delivery.
8.2 Claims for missing issues must be made within three months of the date of publication of the issue being claimed. No claims will be fulfilled outside of this time period.
9. Returns and refunds
9.1 All Goods, unless otherwise agreed in writing by the Supplier, are supplied on a firm sales basis. Returns will not be accepted other than as agreed in accordance with the Supplier’s Returns Policy in force at the time of the return.
9.2 Once an order has been accepted and paid for no refunds will be made in respect of the full term of the subscription or any part of that term except at the discretion of the Supplier in exceptional circumstances.
10. Supplier’s Liability
The Supplier’s liability in all circumstances is limited to the cost of replacing the Goods ordered. It is not intended that any contract between the Supplier and the Customer for the supply of Goods should be enforceable by any third party.
11. Free copies
The publisher reserves the right to refuse an application for a free copy.
12. General
12.1 Any waiver by the Supplier of any of these terms and conditions shall be limited to the particular instance and shall not operate or be deemed to operate as a future waiver of that or any other term.
12.2 These terms and conditions and all other express terms and conditions of sale shall be governed and construed in accordance with the laws of England.
12.3 Notices set by the Customer must be sent by prepaid post to the Supplier at the address on the most recently delivered invoice. Such notices must state the customer’s name and (where applicable) account number. Notices sent by the Supplier will be sent to the customer’s last known address.
Michael Rubenstein Publishing – Terms & Conditions of Sale (Book trade customers only)
Details of our terms and conditions relating to the sale and return of unsold Book trade stock are set out below. For the avoidance of doubt, the provisions of these terms and conditions do not apply to subscription sales of Equal Opportunities Review or any other subscription-based product sold by Michael Rubenstein Publishing.
1. Trade customers can return unsold Michael Rubenstein Publishing stock for a period of up to twelve (12) months from the original Michael Rubenstein Publishing Ltd invoice date for that stock.
2. No goods can be returned later than twelve (12) months from the invoice date, without prior written authorisation from our Chief Executive.
3. Goods will not be accepted for credit if they have been Out of Print for more than three (3) months.
4. Returned stock will only be accepted and credited by us if the above conditions are met, and if the stock is in a condition fit for re-sale.
5. Any Michael Rubenstein Publishing stock returned that is damaged, defaced or not in a condition fit for re-sale, will be returned to the sender un-credited, with an explanatory letter.
6. Customers will bear the cost of postage and packaging for all returned stock.
7. Customers must quote their invoice number when returning goods.
